Before work by a subcontractor can be performed, an approved subcontract must be obtained. The State Construction Office approves subcontracts.   

Until Subcontracts are approved by WYDOT, subcontractors will not have access to the project in CMS.


Subcontractors Information

Most common reasons for disapproval of a subcontract request:

1.  Requested Form(s) DBE-2 have not yet been received and approved for the WYDOT Civil Rights DBE program.  

     a.  WYDOT cannot approve any subcontract requests for a project until all DBE-2's for DBE contractors committed to at time of letting have been received and approved.                            https://www.dot.state.wy.us/home/business_with_wydot/civil_rights.html 

     b.  Email required form(s) to WYDOT's Office of Civil Rights.   dot-civilrights@wyo.gov

2.  All necessary and required documents have not been uploaded and submitted with the subcontract request.  Documents required are as follows:

     a.  Federal funded projects:

          i.  Fully executed and signed subcontract agreement;
          ii.  Fully completed and signed Form FR-2200 (Info pertains to the subcontractor.  All information is required on both pages);
          iii.  Current and unexpired Certificate of Liability Insurance for the subcontractor;
          iv.  Current and unexpired Unemployment Insurance Certificate of Good Standing for the subcontractor;
          v.  Current and unexpired Workers Compensation Certificate of Good Standing for the subcontractor; and
          vi.  FHWA-1273, either as part of the subcontract agreement or as a separate document upload.  

     b.  State funded projects:

          i.  Fully executed and signed subcontract agreement;
          ii.  Current and unexpired Certificate of Liability Insurance for the subcontractor;
          iii.  Current and unexpired Unemployment Insurance Certificate of Good Standing for the subcontractor; and
          iv.  Current and unexpired Workers Compensation Certificate of Good Standing for the subcontractor.

3.  Dollar amounts furnished on the subcontract agreement and the subcontract request (items tab) are not equal to each other.  The dollar amount shown on the request and the dollar amount shown on the subcontract must be equal to each other.

4.  Signatures are missing.  All necessary and uploaded documents requiring signatures must contain the signatures of both the prime contractor and the subcontractor.  

5.  Subcontractor name on documents is incorrect.  All subcontract documents uploaded as part of the subcontract request must be in the name by which the subcontractor is registered with the Secretary of State (either the Wyoming Secretary of State or the Secretary of State for the subcontractor's home state).
