PUBLIC NOTICE OF INTENT TO ADOPT RULES AND REGULATIONS
The Wyoming Department of Transportation (WYDOT) hereby gives public notice of intent, in accordance W.S. 16-3-103, to promulgate the following rules and regulations:

Chapter 32, Alternative Design and Contracting Methods
Chapter 32, Alternative Design and Contracting Methods, is a proposed new rule that responds to current state statutes. The proposed rule provides requirements concerning contractor selection, state funded road and bridge construction, and unsuccessful proposers under different alternative contracting methods. The proposed rule establishes construction manager agent, construction manager at-risk (also referred to as construction manager/general contractor), and design-build as available alternative design and contracting methods that WYDOT may use as defined in W.S. 16-6-701(a)(iv-ix) and as determined by the department to be in the best interest of the State of Wyoming to meet the needs and merits of road and bridge construction projects.

The Wyoming Department of Transportation further hereby gives public notice in accordance with W.S. 16-3-103 that it will hold a PUBILC HEARING to receive public comment on this proposed rule on February 2, 2026, from 12 p.m. to 2 p.m., at the Wyoming Department of Transportation (5300 Bishop Blvd, Cheyenne, WY) auditorium.
Anyone interested may also access the meeting virtually through WYDOT’s homepage, which will include meeting access instructions before the meeting.
